Official Rules
Important: Please read these rules before entering this contest (the "Contest"). By entering the contest you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements set forth below. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.
1. Eligibility. PURCHASE WILL NOT INCREASE ODDS OF WINNING. CONTEST VOID WHERE PROHIBITED. CONTEST OPEN ONLY TO RESIDENTS OF THE (50) FIFTY UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE AT LEAST EIGHTEEN (18) YEARS OF AGE (OR AT LEAST THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE). IF YOU ARE NOT A RESIDENT OF THESE AREAS OR YOU ARE UNDER THE AGE OF EIGHTEEN (18) (OR THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE), THEN YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND COINSTAR, INC. ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers, competitors and employees of Sponsor and any of their respective affiliates, subsidiaries, agents, professional advisors, agencies, and immediate families of each are not eligible to win any prize. All applicable federal, state and local laws and regulations apply. There is no limit to the number of submissions per person or team. However, submissions from a team must be made by a single team representative, and the team representative and each individual team member will be required to sign the winner agreements, affidavits and releases required by Sponsor in order to win a prize. For team entries, the prize will be given/paid to the team representative who submitted the entry for the team. Sponsor will have no responsibility thereafter for payment to the individual team members. If more than one team member submits the same entry, Sponsor reserves the right to disqualify the entry and/or select a team representative in its sole discretion.
2. Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, and each of their respective directors, officers, professional advisors, employees and agencies (together, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Contest.
3. Contest Period. The Contest starts at 12:01 A.M. (all times Pacific Time, unless otherwise expressly stated) on August 1, 2009 and ends at 11:59 P.M. on October 8, 2009, or when Sponsor receives 100 eligible Entry Materials, whichever is earlier (the "Deadline"). All entries must be received by the Deadline to be eligible to win a prize.
4. Grand Prize. The winning entry will be selected by the Judging Panel (defined below). The winner will receive a $10,000 (USD) check.
Odds of winning a prize depend on the number and quality of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER (including the team representative and each individual team member if the winning entry is a team entry). All prizes will be awarded, provided Sponsor can reasonably identify an eligible winner that complies with these Official Rules. Prizes may be forfeited and awarded to an alternative winner if the relevant winner affidavit and materials (see Section 12 below) are not returned within seven (7) days after mailing to winner or if two (2) attempts to contact winner by phone are not successful.
Prizes are not transferable. No substitutions or exchanges of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for the prize or any portion of the prize. The prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
5. How to Enter. To enter, visit www.coinstar.com/ideas (the "Site"), complete the online entry form for the Contest and follow the directions to submit your completed entry/project package online before the Deadline. Each entry must contain written answers to questions in the entry form about a new and innovative business plan/concept for an interactive kiosk (not mere digital signage) to be located in a retail business (the "Concept"). The Concept must include a summary of the idea, monetization strategy, consumer value proposition, market sizing, location strategy, actual or projected economics, and level of concept development, submitted as answers to the questions on the form. All answers must be in writing and contained within the boxes provided. Entrant must also submit a visual depiction of the functionality of the machine in a JPEG or TIFF file format; files must be smaller than 5MB. (Optional: Entrants also may submit supplementary written or visual materials, such as a business plan or additional renderings, as a part of their project package. These supplementary written or visual materials must be JPEG, TIFF, PDF or Microsoft Office formats and be smaller than 5 MB in order to be considered.)
To submit the online registration form, you must agree to the terms of the Contest Submission Agreement located on www.coinstar.com/ideas ("Submission Agreement"), which will be presented for your acceptance during the entry submission process. (Please review the Submission Agreement carefully because it includes important terms regarding your intellectual property rights in your project package.) An entry into the Contest consists of your completed online entry form and your completed project package(s) (together, the "Entry Materials"). Entry Materials received by postal mail, facsimile or other means not expressly permitted in these Official Rules will not be considered. All Entry Materials must be in the English language. All requested information must be provided for your entry to be valid, excluding the optional supplementary written or visual materials described in the preceding paragraph.
By entering the Contest, you consent to being placed on Sponsor’s e-mail mailing list for communcations related to the Contest.
6. Contest Rules. Beginning on or about October 8, 2009 and ending November 1, 2009, a panel of qualified Sponor employees, including but not limited to Sponsor's Strategy and New Business Development Team and senior executives ( the "Judging Panel"), will evaluate entries and select the one (1) winning entry based on the following criteria: (a) the Best Solution for a Consumer and/or Retailer Need; (b) Potential Market Size and Growth; (c) Originality; (d) Practicality; (e) Technical Innovation; (f) Defensibility (e.g., whether it’s easily duplicated, patentable, etc.); (g) Commercial Potential; and (h) Ease of Execution. In the unlikely event of a tie, the winners will be determined by the highest score in the following category: the Best Solution for a Consumer and/or Retailer Need. Sponsor will notify the winner (the team representative for team entries) by telephone using the information provided in the online registration form on or about November 1, 2009. To claim a prize, each winner must follow the instructions contained in his/her notification. Sponsor will announce the winner(s) to the public through a press release and at the Kioskcom event at or around 9:00 A.M. (Eastern Time) on November 10, 2009 at the Jacob K. Javits Convention Center, 655 W. 34th St., New York, NY 10001.
Each person submitting an entry will be eligible to receive free admission (up to five (5) people per team and only one (1) per person regardless of the number of entries) to the November 10-11, 2009 KioskCom self service expo event at the Jacob K. Javits Convention Center in New York, NY. .Approximate retail value is $495.00 (USD).
7. Sponsor License to Entry Materials. You hereby acknowledge that you have read, understand and agree to the terms and conditions of the Submission Agreement including, without limitation, the license you granted to Sponsor pursuant to Section 1 of the Submission Agreement. You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's license rights in the Entry Materials as set forth in Section 1 of the Submission Agreement. Entry Materials submitted to Sponsor in connection with the Contest will not be returned to entrants.
8. No Confidentiality. Sponsor is continuously engaged in active research and development programs, which may generate ideas, functions, features or other aspects that are similar or identical to the ideas, functions, features or aspects of the Concept or Entry Materials. You realize that Sponsor may have access to, or may independently create content and material similar or identical to, the Concept or Entry Materials you submit, and you agree that you will not be entitled to any compensation by reason of the use by Sponsor of such similar or identical material. All Concepts and Entry Materials submitted to Sponsor will not be treated as confidential, and you will not include or disclose any trade secrets or other confidential or proprietary information of a third party in any Concepts or Entry Materials.
9. Non-Infringing Entry Materials. You hereby represent and warrant that you have all necessary rights and permissions to submit your Entry Materials, including without limitation the associated project package(s), and that your use and submission of the project package(s) and Entry Materials in connection with the Contest do not violate, misappropriate or infringe any copyright, trademark, patent, right of publicity or privacy, or any other proprietary right of any other person or entity.
10. General Release. By entering the Contest, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
11. Use of Winner Name, Likeness, etc. Except where prohibited by law, entry into the Contest constitutes permission to use winner (including the team representative and each individual team member if the winning entry is a team entry) name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winner (including the team representative and each individual team member if the winning entry is a team entry) may be required to execute an additional written consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
12. Affidavit & Release. As a condition of being awarded any prize, winner (including the team representative and each individual team member if the winning entry is a team entry) will be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other required legal, regulatory or tax-related documents.
13. Winner List; Rules Request. For a copy of the winner list, send a stamped, self-addressed, business-size envelope after November 10, 2009 and before November 10, 2010 to Sponsor at the address listed below, Attn: Coinstar "The Next Big Idea" Contest Winner List. Residents of VT may omit return postage.

15. Miscellaneous. The Contest and these Official Rules will be governed, construed and interpreted under the laws of the State of Washington. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, cancel, postpone or extend the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
